Welcome to Shop Mosaic Tile. These Terms of Service (“Terms”) govern your access to and use of shopmosaictile.com (the “Site”) and your purchase of any goods or services from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
These Terms form a binding contract between you and GP Food Distribution LLC, a California limited liability company, doing business as Shop Mosaic Tile (“Shop Mosaic Tile,” “we,” “us,” or “our”).
1. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Site or place an order. By using the Site, you represent and warrant that you meet these requirements.
2. Independent Reseller; No Brand Affiliation
Shop Mosaic Tile is an independent reseller of tile products. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to any tile manufacturer, brand, or trademark owner whose products we sell, including but not limited to ELIDA®, ELIDA CERAMICA®, BOUTIQUE CERAMIC®, and BOUTIQUE STONE®. All product names, trademarks, logos, and brands shown on the Site are the property of their respective owners and are used solely for identification and descriptive purposes.
3. Account Registration
To make purchases or access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@shopmosaictile.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or fraud risk.
4. Products, Pricing, and Availability
We make reasonable efforts to display product colors, finishes, sizes, and characteristics accurately, but actual products may vary due to natural variation in stone, ceramic, porcelain, and glass materials, lot differences, and how your screen renders color. We strongly recommend ordering a sample before purchasing tile for a project.
All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors, modify or discontinue products, and limit order quantities at our discretion. If we discover a pricing error after you have placed an order, we will contact you and may cancel the order and refund any payment.
Inventory is sold on a first-come, first-served basis. Listed stock counts are estimates and we cannot guarantee availability until your order is confirmed and paid.
5. Samples
Samples are offered for $2.99 per piece (subject to change) and are intended for color and finish reference only. Sample pieces may not perfectly match the lot of any larger order due to natural material variation. Samples are non-returnable.
6. Orders, Payment, and Acceptance
Submission of an order is an offer to purchase, not a binding contract. A contract is formed only when we send you an order confirmation and successfully charge your payment method. We may refuse or cancel any order, including after order confirmation, in cases of suspected fraud, pricing error, inventory shortage, or violation of these Terms.
We accept Visa, Mastercard, American Express, PayPal, Apple Pay, and buy-now-pay-later providers including Afterpay and Klarna. By providing a payment method, you represent that you are authorized to use it and authorize us to charge the full order amount including taxes and shipping. Buy-now-pay-later services are provided by third parties and are subject to their own terms.
Applicable sales taxes will be added at checkout based on your shipping address.
7. Shipping and Delivery
Free standard shipping is offered on qualifying orders over $99 to addresses within the contiguous United States. Orders to Alaska, Hawaii, U.S. territories, or international destinations are not eligible for free shipping and may incur additional charges or be unavailable. Delivery times are estimates only and not guaranteed.
Risk of loss and title pass to you upon delivery to the carrier. Inspect all shipments at delivery. Note any visible damage on the carrier’s delivery receipt and notify us within 48 hours at info@shopmosaictile.com with photos. Failure to do so may limit our ability to file a freight claim on your behalf.
You are responsible for providing an accurate shipping address. We are not liable for delays, additional charges, or losses caused by incorrect addresses, refused deliveries, or no one available to receive shipments.
8. Returns and Refunds
See our separate Return Policy for details. In summary: unopened, undamaged tile in original packaging may be returned within [30] days of delivery for a refund of the product price, less a restocking fee of [15%] and original shipping costs. Return shipping is the customer’s responsibility unless the return is due to our error or a defective product.
Non-returnable items include: opened or partially-used boxes, cut or installed tile, samples, clearance and final-sale items, and special-order or custom products.
9. Installation; Allowance for Waste
We recommend ordering 10–15% more tile than your measured square footage to account for cuts, waste, breakage, and future repairs. Tile from different production lots may vary in color, shading, and size. Buy your full project quantity in a single order to minimize lot variation. Once installed, tile is deemed accepted and is not returnable.
Shop Mosaic Tile is not responsible for the installation of any product, for labor costs, or for any consequential damage arising from installation. Always follow the manufacturer’s installation instructions and applicable building codes, and consult a qualified installer.
10. Warranties; Disclaimer
Manufacturer warranties, where offered, are provided by the original manufacturer and not by Shop Mosaic Tile. Contact us if you need warranty information for a specific product.
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SHOP MOSAIC TILE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED FROM US, WHETHER IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above limitations may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless Shop Mosaic Tile and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your use of the Site, or your purchase, use, or installation of any product.
13. Intellectual Property
All content on the Site — including text, graphics, logos, images, photographs, product descriptions, software, and the overall design — is owned by Shop Mosaic Tile or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any portion of the Site without our prior written permission. You are granted a limited, revocable, non-exclusive license to access and use the Site for personal, non-commercial purposes consistent with these Terms.
14. User Conduct
You agree not to: (a) use the Site for any unlawful purpose or in violation of these Terms; (b) attempt to gain unauthorized access to any portion of the Site or our systems; (c) interfere with the operation of the Site, including by introducing viruses, malware, or other harmful code; (d) scrape, harvest, or otherwise collect data from the Site by automated means without our written consent; (e) misrepresent your identity or affiliation; or (f) infringe any third party’s rights.
15. Third-Party Links and Services
The Site may contain links to third-party websites or use third-party services (such as payment processors, shipping carriers, and analytics providers). We do not control and are not responsible for the content, practices, or policies of third parties. Your interactions with third parties are subject to their own terms and policies.
16. Promotions and Discount Codes
Promotions and discount codes are subject to the specific terms stated at the time of offer, may not be combined with other offers unless expressly allowed, are not redeemable for cash, and may be modified or terminated at any time. One use per customer unless otherwise stated.

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and disclose information. Please review it.
18. Governing Law; Venue
These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of California, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Except for disputes subject to arbitration under Section 19, any legal action arising out of or related to these Terms must be filed exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction and venue there.
19. Dispute Resolution; Arbitration; Class Action Waiver
Please read this section carefully — it affects your legal rights.
Informal Resolution. Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at info@shopmosaictile.com. We will attempt to resolve the dispute within 60 days of receipt of your notice.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site that is not resolved informally shall be resolved by binding individual arbitration administered by JAMS in San Diego, California, under its Streamlined Arbitration Rules. Judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver. YOU AND SHOP MOSAIC TILE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims or preside over any form of representative or class proceeding.
Exceptions. Either party may bring an individual action in small-claims court, and either party may seek injunctive or equitable relief in court for infringement or misuse of intellectual property rights.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to info@shopmosaictile.com within 30 days of first accepting these Terms. The notice must include your full name and a clear statement of your intent to opt out.
20. Changes to These Terms
We may update these Terms at any time. The updated version will be posted on the Site with a revised “Last updated” date. Material changes will be communicated by reasonable means (such as a notice on the Site or by email). Your continued use of the Site after the updated Terms take effect constitutes acceptance.
21. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including for violation of these Terms. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.
22. Miscellaneous
These Terms, together with the Privacy Policy and any other policies referenced, are the entire agreement between you and Shop Mosaic Tile regarding the Site. If any provision is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision will not be considered a waiver. You may not assign these Terms without our prior written consent; we may assign them freely.
